What is the history of sports betting in NJ?
So, gambling is now legal in New Jersey. Odds are you have a lot of questions. Let’s start from the beginning.
New Jersey has a long history of gambling and a thriving sports betting market, dating all the way back to the 1970’s. But it wasn’t until 2012 that legislation was signed by then governor, Chris Christie, that would allow casinos to offer gambling on professional and collegiate sporting events.
NJ Online Betting & PASPA
This legislation was in conflict with PASPA (The Professional and Amateur Sports Protection Act of 1992), which had been passed by Congress two decades earlier. Lower courts ruled that PASPA was constitutional, overruling the 2012 bill. Thus, this is where SB 2460 comes into play. Introduced in 2014, the bill repealed state prohibitions on sports gambling rather than affirmatively legalizing sports betting. In a 6-3 decision, the Third Circuit’s ruled that “The legalization of sports gambling requires an important policy choice, but the choice is not ours to make. Congress can regulate sports gambling directly, but if it elects not to do so, each State is free to act on its own.”
With this unprecedented ruling, SB 2460 was signed into law in 2018 by New Jersey governor Phil Murphy. Governor Murphy was also the first to place a legal bet in the state; betting on Germany to the win the World Cup, and the New Jersey Devils to win the Stanley Cup. (He lost both bets.)
